MarketPrice Black Eyed Peas promotion Terms & Conditions

  1. By entering the Prize Competition you agree to be bound by the Terms and Conditions.

  2. Employees and shareholders of MarketPrice NZ Ltd (the Promoter) and their immediate family are not eligible to win.

  3. The Promoter has sole discretion on acceptance of entry. The Promoter reserves the right to change the promotion at any time.

  4. Entrants are identified by their personal details submitted when registering for an account on the MarketPrice website, www.marketprice.co.nz (the Website)

  5. The Promoter shall not be liable for any injury, loss or damage whatsoever sustained by any person either directly or indirectly in connection with any prize offered in this promotion, except for any liability, which cannot be excluded by law.

  6. By accepting a prize you agree to be available with no compensation for reasonable publicity and promotional purposes.

  7. The Promoter is MarketPrice NZ Ltd, 88 Anzac Avenue, Auckland City, Auckland. Promoter’s decision is final and no correspondence will be entered into.

  8. No entries will be accepted after 9:00 pm on Monday, 5th October 2009.

  9. There are 2 (two) double-passes to the Black Eyed Peas concert in Auckland on 13 October 2009 to be won individually. Winning the draw means winning one double pass. The Prize Draw will take place on Tuesday, 6th October. The winner must be a referrer of new member(s), and/or a newly referred member, as per (10), (11) and (12).

  10. To qualify for the prize draw as an existing member (referrer):
    Refer an eligible person to register for the Website using your unique referrer code. You get two chances to win for referring your first eligible new member to the Website and one chance to win for any additional eligible new members.

    (a)     You may attain multiple chances to win by registering multiple eligible new members with your referrer code.

    (b)     Eligible new members registered using your referrer code will automatically go in the draw to win, and if any of them wins, you will win also.

    (c) If the winner is not a newly-referred member, they will win one double pass and the Promoter reserves the right to repeat the draw for the second double pass.

  11. To qualify for the prize draw as a newly-referred member (referred):
    Register for the Website using an existing member’s promotion code. This gives you one chance to win.

    (a) If you win, your referrer will automatically win also.

    (b) After becoming a member, you may also become a referrer and attain more chances to win.

  12. Eligibility:
    New members are eligible only if all the following conditions are satisfied:

    1. the new member used an existing member’s promotion code during registration
    2. the new member is not already a member on the Website
    3. the new member is over 18 years of age and a New Zealand resident
    4. the new member agrees to the MarketPrice terms & conditions, available at:

  13. The prize must be picked up in person at a location in Auckland, by agreement between the winner and the Promoter.
    1. The Promoter will be attempting to contact the winner by phone and email on the day of the draw, Tuesday 6 October. If contact with the winner cannot be established by Sunday 11 October 8pm, the Promoter reserves the right to nullify the winner and re-draw the prize to find a new winner.
  14. Cancellation:
    If the concert is cancelled prior to the winner receiving the tickets, then for the purpose of the prize draw, the tickets will be replaced with cash equal to the face value of the tickets. If the concert is cancelled after the winner had received the tickets, the winner should return the tickets to the Promoter in return for a replacement prize equal to the face value of the tickets.

  15. Prizes are not redeemable for cash or exchangeable.

  16. If, for any reason, the administration, security, fairness, integrity or proper conduct or operation of the promotion is interfered with or disputed in any way (including but not limited to computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures) the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; and/or (b) to modify, suspend, terminate or cancel the promotion, as appropriate (including withholding any prizes).

  17. Privacy Act: All entries remain the property of MarketPrice NZ Ltd. All personal information will be collected and stored by MarketPrice NZ Ltd in accordance with the Privacy Act 1993. MarketPrice NZ Ltd may use your personal information to conduct the promotion. You have the right to access your personal information and request correction of any errors in it pursuant to the Privacy Act 1993.

  18. The Promoter reserves the right to change Terms & Conditions.
